Since Hurricane Wilma, our company has had the opportunity to represent and assist several different condominium, cooperative, and time share associations with the presentation and settlement of their property damage claims against their respective insurance carriers. These association claims can sometimes be overwhelming for the Board of Directors and the property manager due to the inherent complications associated with the various ownership interests involved. Trying to dissect and properly bifurcate all of the storm damages between the association’s insurance claim and the multitude of unit owner insurance claims can be a daunting task for anyone that is not a seasoned insurance professional. This cumbersome process can be further complicated and more difficult when the association’s insurance carrier is not adjusting and settling claims in a fair and equitable manner.

In each of our clients’ storm claims, QBE refused to voluntarily pay for the covered and necessary repairs because they concluded that the damages where either not covered under the respective insurance policy, not caused by Hurricane Wilma, or not significant enough to pierce the applicable windstorm deductible. We believe information and documentation obtained from QBE during subsequent litigation confirmed this systemic pattern of unfair behavior.
